16 years old is not a woman. They are both guilty here from my point of view, and shame on anyone downplaying the fact that this girl was essentially baiting old pervs for money.
Apparently they had been meeting up, consensually, and having sex. She had a problem with him filming it though without her permission. She "decided against it as to not upset him in addition to the fact that he could not be certain that he was aware of her true age of 16 years," she told investigators.
So basically:
16 year old girl poses as a legal adult online to attract rich old men, and sells herself for money. When the prostitution is filmed without her consent she reveals that she is actually 16 and gets the guy arrested for making child porn and extorting a child
Edit: Just found out that in that state 16 is the age of consent, that's an important fact as well.
Love how so many people when they read the first articles jumped to conclusions and assumed this guy was forcing children to pose nude or something.
Couple of nuggets to let y'all know free of charge since I'm an Assistant District Attorney in the great state of Texas....
1. If there was any sex act then = Statutory Rape b/c under 18. Doesn't matter what age of consent is all 50 states, the fact of the matter is that shes under the age of majority controls;
2. Regardless of the girl clearly baiting the guy, the whole "she looks 18 and over" and "shes registered on a sugar daddy site meant for adults" is not a defense. Age is age. The fact she is under aged = dude screwed.
Sounds like this is this guy's first run in with the police. What is most likely going to happen is that he will get a 5 to 10 year probation (aka is convicted of the crime but will not serve jail time) and have to register as a sex offender for life. Failure to register = felony = prison time in which your run of the mill felon does not look kindly to those who dabble with under-aged boys and girls. After a few years no one will remember this.....but given how he has to register as a sex offender i wonder if he can go to gaming conventions and such where minors will be present. If he ever gets back in the biz he will be behind the scenes.
This kind of legal advice would've costed the clan over $300 an hour. You're welcome for the donation.
