No, it's not. It's only abusing the warning rule if they come out with 'where's my warning? I should have been warned' for when they know and you know for a fact they shouldn't have been warned and that's abusing the warning rule.
This case, you do
NOT need to give AFK Checks though you still can if you're nice enough to give people 5 seconds or so to come back (if they see it).
Or as an admin, slap once, wait 2 seconds and spectate if no response, easy as that.
